They see that you are making money as a business and want a cut of it, but in most cases what they do is Identity theft where they duplicate your  first name or part of your name as a stage name, services, websites that look just like yours copied, changed and made to look like infringement, and even lie about, fabricate and exaggerate their years of experience, years of being in business, expertise, background, their work, their trademark and enforcement there of and so on.

Cyber Scam/Con artists are cunning, manipulative, harassers, stalkers, terroristic, twists the situation or truth around, sociopath liars, sociopath (individual who cant fit into society normally and justify their actions as right regardless of whether they are right or wrong), know the ins, outs  and cracks of the legal system and courts to twist it to make it look like they are the victim. They do not work well with others, control situations, not able to get along with others, and use any means or tactics legal or not legal to achieve their goal including con the Court and Judges. • Courts, FBI, Law Enforcement:. The courts, with the help of individuals such as yourself working with the law, FBI, and enforcement agencies are now spotting such con/scam artists by the reporting of such individuals and their actions. Court filed documentation with every detail and evidence of such crimes as harassment, stalking, terrorizing, false claims, misrepresenting themselves or their trade mark name. Some have a fax number, we suggest doing both and filing a complaint with this company against this individual. Companies such as Yahoo, & Google, are just a few that have a policy against such abusive behavior. Report it as email or spam abuse and ask for the individuals email account to be pulled. More than likely if this individual is doing it to you, they have a past record of doing it to someone else, may have had accounts pulled from before or in current warning.

• About Phone Calls: Record all conversations. In this situation if you are going through this same thing by the use of the phone, to protect yourself, go out and buy a special recorder which is inexpensive not costing much or a devise that allows you to tape from the phone the conversation. You can Even use the speaker phone and record that way, but it might not be as clear. By getting a clear connected recording you can have clear concise recording that you can use in court, or with your attorney.  Tell the caller or individual harassing you that you are recording all phone calls from them for your protection.

• About Why Phone Calls, Emails etc: About the individual who is doing it. Usually the individual who is doing the harassing, stalking, threatening, terrorizing and such does not want any form of documented proof that can be used against them or in the court of law. This will deter and help to stop them from bothering you. This is the face of a scammer/con artists, be knowledgeable.

• Websites & Website Hosting Companies: Know all your information regarding the legality and legal rules of the company that you are using and how they deal with Infringement, Stalking, Terrorizing, Cyber Squatting and Harassment.

 Keep your web hosting company informed if you are running into problems with this. Most will work with you, because they want you as a customer.

Most companies will require a legal document before pulling any website down directly by the Court and signed by the Judge that is a Ruling, Injunction or Judgment in that particular case or situation. These must come directly from the Court itself to the Hosting Company, not from the opposing party to be accepted.

An individual claiming such rights can not legally contact your web hosting company and have your web site pulled without the actual Court Order being requested to be sent to the Hosting Company by the Court itself directly. A request to the Court must be filed and the Court will choose whether it will comply with the request or not or just ignore it. If the individual does not have any legal rights to do so or is not the trademark legal name the Judge may not respond and may choose to ignore it not sending one. Without one directly from the Judge and the Court itself there is no legal action to be taken by this individual and you are protected.

 A few web hosting companies like Go-Daddy. COM policy is to pull the website if there is evidence of a government registered trademark or court action by the opposing party, without an actual Court Order directly from the court and by the hear-say of the individual with the trademark and any court action taken and regardless of the evidence of common law trademark rights of years before which they do not recognize. In our case their policy was to pull it after continued harassment, from the opposing individual, regardless there was no legal court documentation directly from the court in ruling or court judgment that was at that time in progress and set for a court hearing date.  They do not protect you from such individuals and do not refund any fees and do not hold themselves liable. Choose wisely your hosting companies for your protection.

 Because of the Cyber swatting that is done today, such companies need to be leally informed and knowledgeable taking the right action for all parties involved and not one-sided.

In most cases web hosting companies will protect their clients and the privacy of their clients. If there is a problem such as trade mark, again they will request the information from the Court directly or have the individual complaining using their business trade mark to pull a website down, to contact the Court and Judge and again have the Court send the information, ruling, judgment or injunction signed by the court directly to them before any action is taken. Such companies as Black Sun Web hosting company in Canada requires this. All records are kept of stalkers, harassment, etc. in the means to help their client and in the protection of their client against such individuals.

An individual who is a scam artists and con artists will go behind the scenes illegally and try to have the website pulled by the web hosting company based on their idea and view of the law or their twisted view of their legal rights regardless if they have court action and hearing pending for an injunction or ruling.

• About You & What You Can Do To Help Stop This: When you are being stalked, harassed, terrorized, and your identity stolen by someone else claiming services and such exactly like you, be aware of what to do and share this information with your associates, clients, friends, family and the public. Share information, post it on your website. Don't allow fear of this person or their actions of terrorizing, threats, stalking and harassment to keep you from taking action. They will continue and will never stop, they will never go away. By not being public and sharing the information you help to keep it going keeping the public and others going through it in the dark. Fear of the person or fear of taking action only continues the reign of fear by this individual or group. Do not defame or be defamatory toward others. Use only the truth and facts, any court cases and documentations is also beneficial in sharing the information, telling the full truth of the story and your side. Remember to not be one sided. • About Pro Sec: Pro Sec which is allowed by the courts as a "privilege" not a right, in self representation because of the high cost of court costs and attorneys by individuals in most cases who cannot afford the cost, is being used by many as a means to abuse the court systems and by scam artists to take short cuts in these particular situations. It is best to file against this individual (s) in your own country or state with your own legal licensed attorney and court order requiring them to have a actual licensed attorney representing them in court as well. If need be file for a restraining order for your protection. Know Your Legal Rights & Stand Up For Them. This is against the law. Cost involved is usually a filing fee set up by the court based on fees in that area. Permission must be asked of the court to be Pro Sec self representing. We still advise a licensed practicing attorney to be used as advisor even if you file yourself. Please do not take short cuts, or use law students, if you want expertise of an expert, and to win your case.

• About Court: If you have to go to court make sure you are represented and advised by a licensed practicing knowledgeable attorney in the trade mark field. If you represent yourself pro sec, make sure you are advised licensed practicing knowledgeable attorney. Try to settle the dispute out of court first by use of attorneys and use the Court system as the last means to settle the dispute. Keep all contact regarding this individual and from this individual directly through your attorney. If they stall around, that means they do not have legal representation nor do they intend to get any, but will bull shit about being represented and other claims, this is a scammer and con artist. Some one that is on the up and up and truly legal and honest will have licensed legal representation in trademarks or will hire someone that they will use. They will not continue to blow hot air at you disguised with treats, staling, harassment and so on. Do not accept any yourself. This allows this individuals to continue to have control, stalk, harass, psychically, emotionally, and mentally rape you. Take the control out of their hands. Remember stalking, harassment, terrorizing and such by an individual is just a means by them to get you to give up and also as a means to distract you from their real purpose or action so you loose out. You do not have to accept or put up with such behavior and can file a enforceable restraining order against them.

Research the government registration trademark name, when was it actually received.   • About Common Law Trademarks: Common law trademarks are acceptable legally on the internet and publically with documented proof in years of established usage. Government registered trademarks are not required by law and common law trademarks can be claimed as legal registered trademark name of business or individual or any descriptive name connected to their services. It is important to have documented proof of usage of the name or such of the internet as well if you do not have a government registered trademark. Just having proof of internet usage is not enough.   • About Government Registered Trademarks: It is the individuals responsibility that is registering with the government to do all forms and kinds of checks for the use of the individual name or business name. It is required to not only use the government registration search but the internet and phone books by doing extensive searches for the use of the name or business name. In most cases when a thoroughly or complete search is not done, and individual will register a government trademark name on top of an existing well established name or business name. In some cases this is the tactics used by scammers or con artists as reported by the FBI to cut in on an already established trademark name or business name or even description of services to take short cuts, remove their competition, file false trademark claims, file false court documents, harass, stalk threaten and terrorize others.
